In a boat dispute the parties often give the same defect different names: one says "old damage", the other "yard error". An independent technical report moves the argument onto ground built on readings and photographs.
1. Which disputes it is used for
- Sale and purchase: whether a defect found after purchase existed before the sale.
- Yard and refit work: whether work meets the contract, specification and standards; missing or faulty work.
- Insurance: extent of damage, link to the incident and reasonableness of repair cost.
- Accidents and collisions: location, shape and probable mechanism of damage.
- Charter and hire: differences between delivery and return.
2. What the report contains
- Date and place of inspection, those present and documents reviewed.
- Readings (moisture, thickness, electrical, temperature) and photographed findings.
- A technical explanation: what the finding is, how it arose and how long it may have existed.
- Assessment against standards and contract terms.
- Repair method and a cost range.
- Limits of the report: non-destructive inspection and matters that cannot be determined are stated clearly.
3. How it differs from a court-appointed expert
We are not a court-appointed expert. Our report is an independent technical inspection made at the request of a party or their lawyer, often called a party expert opinion. How it is used in proceedings is for your lawyer to decide.
Whoever commissions it, findings rest only on measurement and observation; we do not shape conclusions to the client's expectations. See the independence statement.
4. Timing matters
In a dispute the most valuable evidence is the condition when the defect first appeared. Inspecting before repair, relaunch or dismantling preserves it. If repair cannot wait, readings and photos are taken first and removed parts are kept.
Inviting the other party to attend the inspection reduces later argument about the findings.
