This page sets out the terms on which SurveyYat services are provided. A written contract is issued for every job; in any dispute the contract text governs. What follows tells you what to expect before you sign it.
1. Scope
A survey is the record of what was found on a given date, within a stated scope, in the areas that could be reached. Dismantling, cutting, destructive testing and opening coatings are outside the scope and are agreed separately if required. Areas that could not be reached are written into the report as limitations, and a limitation does not mean there is no defect there.
For a delivery, the scope is defined by departure port, destination, crew number, who pays for fuel and port charges, and the terms for weather waiting.
Limits of a survey: The report reflects what was observed and measured on the survey date; it is not a warranty or undertaking about the boat's future condition. Checks that need dismantling or special equipment (engine internals, tank interiors, masthead) and separate tests such as compression or oil analysis are in scope only if agreed separately. A valuation is an expert opinion; it moves with the market and is not a promise of a sale price.
Calculators: Figures and durations from the calculators on this site are estimates, not binding offers. Only the written quote given before work starts is binding.
Safety and insurance on deliveries: Decisions to sail, the route and weather calls rest with the skipper for safety. During a delivery the boat stays under the owner's insurance policy; cover for the delivery is confirmed in writing before departure.
2. Fees and Payment
- The fee is confirmed in writing before work begins, with inclusions and exclusions listed separately.
- The survey fee does not depend on the findings. It does not change because the report is unfavourable, and it does not change because it is favourable.
- Delivery payment is 50% on booking and the remaining 50% before departure.
- Marina, crane, hardstanding, fuel and agency costs belong to the owner unless stated otherwise. No commission is taken on any of these.
- Travel and accommodation outside the working area are priced separately and shown in the quotation.
3. Cancellation and Postponement
- Survey: free cancellation up to 48 hours before the appointment. At shorter notice, travel costs and the reserved day may be charged.
- Delivery: cancellation up to 48 hours before departure: the booking payment is refunded or moved to a new date; at shorter notice it is not refunded.
- Weather: the decision to sail rests with the skipper. A postponement for weather is not a cancellation; a new window is agreed together.
- If the boat is not ready for measurement, not enough time ashore, no access arranged, travel costs may be charged.
4. Ownership and Confidentiality of the Report
The report belongs to the party who paid for it. It is not shared with the seller, the broker, a yard or any third party without the owner's written permission. Reports are archived for 24 months and a copy can be requested within that period.
A report is valid for the person it was issued to and for that transaction only. Transferring it to another buyer or using it as sales material requires written permission.
5. Independence and Conflict of Interest
- We do not sell repair work on a boat we have surveyed.
- We take no commission from yards, marinas, painters or parts suppliers. If you ask for a recommendation, you get several names.
- We do not act for both buyer and seller on the same boat.
- If any possibility of a conflict exists, it is disclosed in writing before the job is accepted.
6. Limitation of Liability
Liability arising from the service is limited to the fee charged for that job. This limit is common in the industry and is stated explicitly in the contract.
In addition:
- A survey is not a guarantee. Future performance, freedom from breakdown and resale value are not warranted.
- No liability arises from areas recorded in the report as limitations.
- Indirect loss, loss of profit, loss of use and third-party claims are excluded.
7. Safety of the Boat and Third Parties
Running machinery, conducting a sea trial and testing systems during a survey happen with the owner's permission. If an existing defect reveals itself during those operations, an engine failing when started, for instance, that is not the surveyor's liability.
On a delivery the boat remains covered by the owner's own insurance from handover to handover; before departure, written confirmation that the policy covers the passage is obtained. Without that confirmation the delivery does not start.
8. Personal Data
How your data is handled is set out on the Privacy and Data Protection page. In short: what you send is used to prepare a quotation, carry out the work and meet statutory record-keeping. It is not added to marketing lists and it is not sold.
9. Disputes
Any dispute is first addressed in writing between the parties. Failing that, the law of the Republic of Türkiye applies and the courts and execution offices of İzmir have jurisdiction. Where a party acts as a consumer, the right to apply to the consumer arbitration committees is reserved.
10. Changes
These terms may be updated. The text that applies to you is the one in force on the date you signed your contract. Last updated: September 2026.
